1. General provisions
Asgard Express (the “Company”) offers legally capable adults access to the Asgard Express website and service (the “Platform”) on the terms below.
Submitting a request and checking the acceptance box constitutes full and unconditional acceptance of this offer. Users who do not agree to these terms must not submit a request.
2. Definitions and Platform status
The User (Customer) is the passenger placing a request. The Driver (Carrier) is an independent individual, sole proprietor or legal entity that accepts the request and provides transport using its own or another lawfully operated vehicle.
The Platform is an IT and marketing product for placing requests, finding potential Drivers and sharing contact information with the User’s consent. The Platform is not a carrier, does not operate vehicles, issue tickets, accept passenger transport payments or act on behalf of a Driver unless expressly stated otherwise.
3. Subject of the offer
The Platform provides a free request interface and facilitates initial communication with a potential driver. A request does not guarantee vehicle availability or confirm a trip.
The specific Driver, vehicle, time, price, payment procedure, luggage and other terms are agreed directly between the User and Driver. The transport agreement is concluded between them after both parties confirm the terms.
4. Request and confirmation
The User must provide accurate contact and route information. The operator may contact the User through the selected channel, clarify details and share information with a potential Driver to the extent required to arrange the trip.
Departure time is agreed individually and becomes final only after confirmation by the Driver. Travel time and prices shown on the website remain estimates until that confirmation.
5. Price and payment
Passengers do not pay the Platform for transport and settle directly with the Driver. The Platform does not store passenger payment details and is not responsible for cash or cashless payments between the parties to the transport agreement.
Prices in KZT, RUB and USD are manually set estimates rather than live currency conversions. A 1.25 coefficient is applied once when pickup from or arrival at an airport is requested.
6. User obligations
The User is responsible for checking identity documents, border-crossing eligibility, visa and migration requirements, luggage rules and restrictions relating to the User, children, animals and property. Decisions of public authorities are outside the Platform’s control.
The User must follow lawful Driver and authority instructions, carry no prohibited items and disclose material trip requirements in advance.
The User must take reasonable care of the Driver’s vehicle and other property. If the User or accompanying persons cause damage to the Driver’s property, or if the passenger compartment requires specialist cleaning, the User must compensate the Driver for the damage caused, including interior dry-cleaning costs. The Platform is not liable for such damage, does not resolve related disputes and is not a party to claims or settlements between the User and the Driver.
7. Driver and transport
The Driver is independently responsible for the legality of transport, vehicle roadworthiness, permits, insurance, road safety, work and rest limits, accepted luggage and harm caused during transport within the limits of applicable law and the concluded agreement.
Vehicle makes and models indicate the expected class. A Driver may offer an equivalent replacement, subject to User acceptance before departure.
8. Platform liability
The Platform remains responsible for proper provision of its own information service, its personal-data protection obligations and the accuracy of information published in its own name. Nothing in this offer excludes liability that cannot be limited under the laws of the Republic of Kazakhstan.
The Platform does not control Driver conduct, transport outcomes, accidents, luggage in Driver custody, authority decisions, queues, weather, road conditions or consequences of inaccurate User information, except where mandatory law provides otherwise.
9. Trip conditions, delays and force majeure
The estimated travel time shown on the website may change due to road conditions, mandatory inspections, actions of public authorities, road works, weather, traffic restrictions and other circumstances. Such circumstances do not in themselves constitute a defect in the Platform’s information service.
10. Personal data
Contact and route data is processed and shared under separate consent and the Privacy Policy. Consent may be withdrawn via asgard-express@proton.me, unless retention is legally required.
11. Claims and disputes
Claims about the Platform’s information service should be sent to asgard-express@proton.me. Transport claims should be addressed to the Driver, without prejudice to the User’s right to notify the Platform for an internal review of the cooperation.
The laws of the Republic of Kazakhstan apply. Mandatory consumer rights and jurisdiction rules remain unaffected.
